MEMORANDUM OPINION AND ORDER DENYING CONFIRMATION AND LIFTING AUTOMATIC STAY

The confirmation hearing to consider the debtor in possession’s Second Amended Plan of Reorganization was held in Ra leigh, North Carolina, on September 13, 1989. 1 The issue presented is whether the plan proposed by the debtor in possession is “fair and equitable” as that term is used in 11 U.S.C. § 1129(b)(1).
