OPINION OF THE COURT ON BRIEFS SUBMITTED IN LIEU OF TRIAL
McKEAGUE, District Judge.
This case presents a controversy concerning the scope of coverage afforded by a homeowner’s insurance policy. Plaintiff Horace Mann Insurance Company brought this action for a declaratory judgment pursuant to 28 U.S.C. § 2201 and Fed.R.Civ.P. 57. Plaintiff contends that, because of an exclusion provision in its policy issued to defendant William Stark, it has no duty to defend or indemnify him for any claim or legal action filed on behalf of his granddaughter, defendant Alyssa Sherman.
