On July 14, 1963, at approximately 2:30 a.m., defendant Hone was driving a tractor-trailer truck owned by defendant Happy-land Shows, Incorporated, within the city limits of Traverse City, Michigan. Defendant Hone, in order to ascertain whether the rear lights on his vehicle were functioning properly, stopped the truck in the right-hand lane on Munson Avenue, which is a four-lane street designated as a state trunkline highway.
