concurring in the court's disposition and dissenting from today's pronouncement.

11 Today's opinion affirms the nisi prius order that directs the State Board of Medical Licensure and Supervision [Board]1 to grant a medical license to the plaintiff-ap-pellee, Dr. Chaudhury Dhana Koteswara Davuluri, M.D. [Dr. Duvuluri]. While the court's conclusion-that this Board's order may be reviewed in the district court-is consistent with my dissenting message in Naifeh,2 its pronouncement reinfuses Naifeh's core holding with a claim to constitutional orthodoxy which I continue to reject.…
