SMITH, Justice.

Appellant brought this action for recovery of damages to real property allegedly caused by respondent’s blasting operations, and by his alleged diversion of the waters of Pa-louse River; also to compel respondent to clear the stream bed of the river, and to enjoin respondent from further blasting operations and further encroachment upon Palouse River in the vicinity of appellant’s property. Respondent denied the allegations of appellant’s complaint. The trial court denied any relief to appellant and entered judgment of dismissal of the action with prejudice. This appeal…
