In an action to recover damages for legal malpractice, the plaintiff appeals from an order of the Supreme Court, Kings County (Kramer, J.), dated July 24, 2009, which, in effect, granted those branches of the defendants’ motion which were to dismiss the complaint pursuant to CFLR 3211 (a) (5) and (7).
Ordered that the order is modified, on the law, by deleting the provision thereof, in effect, granting that branch of the defendants’ motion which was to dismiss the complaint pursuant to CFLR 3211 (a) (5) and substituting therefor a provision denying that branch of the motion; as so modified,…
