In an action to recover damages for legal malpractice, the defendant appeals from an order of the Supreme Court, Kings County (Schack, J.), dated April 9, 2010, which granted the plaintiffs motion for summary judgment on the issue of liability and denied his cross motion for summary judgment dismissing the complaint.

Ordered that the order is modified, on the law, by deleting the provision thereof granting the plaintiffs motion for summary judgment on the issue of liability and substituting therefor a provision denying the plaintiffs motion; as so modified, the order is affirmed, without costs…
