MEMORANDUM AND ORDER
DITTER, District Judge.
Before me are plaintiffs motion for partial summary judgment and defendant’s cross-motion to dismiss plaintiff’s complaint for declaratory relief. For the reasons set forth below, I will decline to exercise jurisdiction and will grant defendant’s motion to dismiss.
