The information in this case charges that in Delaware county, July 25, 1924, Marvin Bryant did take, steal, and carry away a Studebaker chummy roadster, 1920 model automobile, the personal property of Harve Fender. On the trial, the jury returned a verdict finding the defendant guilty, but were “unable to agree upon the penalty.” October 15, 1924, the court denied a motion for a new trial and sentenced 'defendant to imprisonment in the state reformatory at Granite for the term of 10 years.
