McMILLIAN, Circuit Judge.

Timothy Gilbert appeals from a final judgment entered in the United States District Court for the Eastern District of Arkansas, denying his petition for writ of habeas corpus. Gilbert alleged that he was denied his sixth amendment right to legal counsel because he was forced to proceed to trial either pro se or with unprepared counsel, and because the state trial court failed to elicit an intelligent and voluntary waiver of counsel. For the reasons discussed below, we reverse the judgment of the district court and remand the case to the district court with directions…
