Petitioners-Appellees, by and through their parents, filed suits under the National Childhood Vaccine Injury Act of 1986, 42 U.S.C. § 300aa-l to 300aa-34 (2006) (“Vaccine Act”), alleging that they suffered from epilepsy or a seizure disorder, as a direct result of the diphtheria and tetanus toxoids and acellular pertussis vaccine (“DTaP”). The same Special Master presided over Petitioners’ cases and denied compensation finding, in part, that a genetic mutation was the sole cause of the seizure disorders in both cases. Hards v.
