OPINION

NYE, Justice.

This is a child custody case. Fred M. Dohrmann brought habeas corpus proceedings to obtain the custody of his three year old daughter Malinda Lee Dohrmann from *234her mother. He alleged that he was entitled to custody under and by virtue of a judgment in North Dakota. The mother, Lesly Lee Dohrmann Chandler, answered and by cross-action sought judgment awarding the custody of the minor child to her.
