I. INTRODUCTION

The United States Commodity Futures Trading Commission (“CFTC”) brings this civil enforcement action alleging that Defendant Gordon Driver (in part through his corporate vehicles Axcess Automation LLC and Axcess Fund Management LLC) operated a Ponzi scheme1 from February 2006 through May 2009.
