MEMORANDUM DECISION AS TO CONFIRMATION OF FIFTH AMENDED PLAN

E. STEPHEN DERBY, Bankruptcy Judge.

This matter is before the Court for confirmation of Debtor’s Fifth Amended Plan of Reorganization (as Finally Amended) (herein the “Plan”). Objections to confirmation have been filed by Fairfax Savings, a Federal Savings Bank (“Fairfax”), the primary secured creditor of Debtor, and by certain insider unsecured interests, including the former general partners of Debtor and referred to herein as the Ellerin parties. The objections were heard at a confirmation hearing conducted over several days.…
