This is an original proceeding in mandamus to require Hon. J. T. Parks, District Judge of the First Judicial District, to certify his disqualification in an action pending in the District Court of Sequoyah county, wherein the state of Oklahoma prosecutes the petitioners Bess Conley and J. M. Conley on a charge of murder. In the petition it is alleged that the said respondent as district judge is biased and prejudiced against the petitioners so they cannot receive a fair and impartial trial.
