In a seven-count indictment, defendants Anthony Robinson and Kenneth Simmons, together with one David Goss who is not involved in this appeal, were jointly charged with murder, armed robbery, aggravated battery and unlawful restraint. Goss was tried alone and convicted. A short time later, defendants pled guilty to murder, armed robbery and aggravated battery. Robinson was sentenced to serve concurrent terms of 25 to 100 years for murder; 5 to 10 years for armed robbery and aggravated battery.
