This is an action on the case against the township to recover damages for a personal injury sus*188tained by the plaintiff — a married woman, about 55 years of age — by falling into a ditch or drain in one of the public highways of said township on the night of August 14, 1909. At that time the plaintiff resided with her husband on the S. E. ¼ of the N. E. ¼ of section 10 in said township, and had lived there for many years. Her son-in-law, Harvey Lee, lived, as he had for some time prior thereto, on the N. E. ¼ of the N. E. ¼ of the same section, and about one-quarter of a mile north of…
