A statement of the facts will facilitate an understanding of the assignments of error advanced by the defendant-appellant, John Gf. Grosz, who is the father of the plaintiff. February 25, 1924, when the plaintiff was 18 years of age, his father obtained from the defendant life insurance company a 20-pay life policy of insurance in the denomination of $5,000 upon the life of the plaintiff. The annual premiums were $158.90. A monthly disability payment of $50 was payable to the insured in the event he became totally and permanently disabled before reaching the age of 60.
