Appeal by the relator, Patrick H. McCarren, from an order of the Supreme Court, made at the Kings County Special'Term and entered in the office of the clerk of the county of Kings on the 14th day of July, 1908, denying the relator’s application for a peremptory writ of mandamus compelling the board of elections to select and appoint election officers from the list filed by the relator. Rich, J.:

The relator is chairman of the executive committee of the county-committee which was duly elected at the annual primary election in the year 1907 as the Democratic county committee of Kings county. In June, 1908, as such chairman he filed with the board of elections of the city of New York a duly authenticated list of the inspectors poll clerks and ballot clerks for each election district in the county of Kings to- represent the Democratic party in said county on the various boards of elections.
