Plaintiffs claim for damages from an alleged taking of his property and for breach of contract is before the court after argument and supplemental briefing on defendant’s motion to dismiss under RCFC 12(b)(1) for lack of subject matter jurisdiction or, in the alternative, under RCFC 12(b)(6), for failure to state a claim for relief.
