MEMORANDUM OF DECISION AND ORDER

This is a case of first impression involving § 438(b)(2) of the General Education Provi*591sions Act, popularly known as the Family Educational Rights and Privacy Act of 1974 (the “1974 Act”), 20 U.S.C. § 1232g(b)(2) (Supp. IV, 1974). It also raises important questions concerning a school district’s responsibility to provide remedial programs for students with limited English language ability.
The case is before us on a motion to compel answers to interrogatories, pursuant to Rule 37(a) of the Federal Rules of Civil Procedure. The individual…
