Tills is a motion pursuant to CPLR 2304 to quash a subpoena. The court finds the issuance of this subpoena to be most unusual and a review of the facts is necessary that it be understood.

*43The decedent, Richard Blake, at the time of his death in 1949 was an employee of the American International Underwriters Corporation. He died in occupied Germany as the result of an automobile accident, having been taken to the 387th Station Hospital of the United States Army. The death certificate issued by this Army hospital shows that he died on August 10, 1949 at 2:40 a.m. from injuries…
