MEMORANDUM OPINION AND ORDER
ROBERT D. BERGER, Bankruptcy Judge.
This declaratory judgment action is before the Court on Plaintiffs motion for summary judgment 1 and Defendants H. Kent Desselle’s and Check Electric Construction Company, Inc.’s motion to dismiss. 2 The Court has jurisdiction under 28 U.S.C. §§ 157 and 1334 over issues regarding Debtors’ Chapter 13 plan obligation to assign a lawsuit to Plaintiff Travelers Casualty & Surety Company (“Travelers”) free and clear of liens.
