On May 10, 1943, plaintiff filed his complaint seeking to enjoin the defendant from violating the provisions of Sections 7(a) and 11(c) of the Fair Labor Standards Act of 1938, 29 U.S.C.A. §§ 201-219, hereinafter called the Act.

Section 7(a) of the Act requires that employees engaged in interstate commerce or in the production of goods for interstate commerce be compensated at rates not less than one and one-half times the regular rates at which they are employed for all hours worked in excess of 44 per week during the first year after October 24, 1938, in…
