This was a suit upon an account for goods sold, brought by the plaintiff in error against the defendant in error, to which the defense of former adjudication was interposed. Lykins, Adler and Westenbérger were partners in the mercantile business and became indebted to Farwell & Company for goods purchased. They dissolved partnership, undei* an agreement that Lykins should retire from the firm, and that the others should assume the payment of the partnership debts and should continue the business under the name of Adler & Company.
