HAYMOND, PRESIDENT :

plaintiff brouglit an action of ejectment against ¿efen(jan^ [n December, 1872, to recover from the defendant several lots of ground situate in the city of Wheeling, then in the possession of the defendant, and claimed by the plaintiff. The action was brought in the circuit court of the county of Ohio. The plea filed by the defendant was that “it is not guilty of unlawfully withholding the premises claimed by the plaintiff in its declaration and on this plea issue was joined.
