This was an action on the case brought by the plaintiff to recover damages for personal injury received on the defendant’s railway train in the county of Tucker, on or about the 22d day of July, 1889. The defendant appeared to the action, and demurred to the declaration, and to each count, but the demurrer was overruled. After the evidence was all in, the defendant moved to exclude the whole evidence, which motion was likewise overruled.
