NORTHCOTT, Circuit Judge.

This is an action brought by S. B. Shipp, appellee, hereinafter referred to as the plaintiff, against Consolidated Textile Corporation, appellant, hereinafter referred to as the defendant, for injuries to the plaintiff while working in the mill of the defendant. Action was brought in the superior court of Wake county, N. C., and was removed to the District Court of the United States for the Eastern District of North Carolina. In September, 1929, a trial was had; the jury returning a verdict for the plaintiff in the sum of $3,000. The court below entered judgment upon…
