MEMORANDUM AND ORDER
NICKERSON, District Judge:
Defendant National Organization of Industrial Trade Unions Insurance Trust Fund (the Fund) moves pursuant tp Local Civil Rule 3® to reargue a motion decided by this court on November 30, 1992, granting partial summary judgment to plaintiff Karl Ritzer (now deceased). The court assumes familiarity with its previous memorandum and order. Ritzer v. Nat’l Org. of Indus. Trade Unions Fund, 807 F.Supp. 257 (E.D.N.Y.1992).
