DUNKLIN, Justice.

This suit was instituted by the Texas & Pacific Railway Company against the Texas Steel Company to recover the sum of $2,014.-38, the amount paid out by plaintiff to Robert W. Hunt & Co. for testing steel and other materials manufactured by the defendant to determine whether or not plaintiff would consent to the use of such material in the construction of pier abutments and pedestals for a new double-track bridge which the plaintiff contemplated building near Fort Worth.
