OPINION

JONES, District Judge.

In this employment discrimination case, the plaintiff claims that he was denied employment by the defendant solely because of his age. The defendant has moved for summary judgment on both procedural and substantive grounds. First, the defendant argues that the action is barred because the plaintiff did not file a discrimination charge with the EEOC in a timely manner.
