INTRODUCTION
Plaintiff, Koon Chun Hing Kee Soy & Sauce Factory, Ltd. (“Koon Chun”), brings this action against defendants for trademark infringement based upon defendants’ sales of counterfeit versions of plaintiffs hoisin sauce. On January 8, 2007, 2007 WL 74304, the Honorable Joseph F. Bianco granted in part and denied in part the parties’ cross-motions for summary judgment. Docket Entry 162 (hereinafter “M & O”).
