This action is brought under the Federal Employer’s Liability Act, 45 U. S. C. A., §§ 51-59, to recover damages for the death of appellant’s intestate, a railroad conductor in the employ of respondent, and who was the conductor in charge of the movement of a large new type of engine, without cars attached, from Rocky Mount, North Carolina, to Florence, South Carolina.
