This matter is before the Court on DEFENDANT NATIONAL INDEMNITY COMPANY’S MOTION FOR SUMMARY JUDGMENT (Docket No. 181), pursuant to Fed.R.CivJP. 56, and DEFENDANT NATIONAL INDEMNITY COMPANY’S MOTION FOR LEAVE TO FILE AN AMENDED ANSWER AND AFFIRMATIVE DEFENSES (Docket No. 165).
