The plaintiff, J. E. Mundy, sued the defendant, Pirie-Slaughter Motor Company, for damages resulting to him when a tractor mower which he was operating in the ditch adjoining the Fort ■ Worth-Dallas Highway was struck by an automobile belonging to the defendant. The State of Texas intervened in the suit, claiming rights by subrogation because of workmen’s compensation payments made to Mundy as an employee of the State Highway Department.
