MEMORANDUM OF DECISION GRANTING DEFENDANT’S MOTION FOR SUMMARY JUDGMENT

Just before the start of jury selection and trial scheduled for January 11, 1994, we granted 1 NYNB’s renewed motion for summary judgment dismissing CEPA’s complaint to avoid preferential transfers aggregating $5,716,000. Our doubts about the viability of CEPA’s ease were first raised by NYNB’s Motion for Judgment on the Pleadings, which we elected to treat as a motion for summary judgment, and denied without prejudice to NYNB’s right to renew the motion just prior to trial.
