The defendant, K. A. Price, in his brief abandons most of his assignments of error. The defendant’s assignment of error which relates to the refusal of the court below to give the special in struction asked, addressed itself to tbe failure of Dr. P. D. Pence to confirm tbe sale. Tbis contention is based on tbe option given by Price to Doctor Pence. Tbis 90-day option was dated 16 October, 1922. Doctor Pence bad a mortgage on tbe land, and tbe terms of tbe option were tbat Price was to cooperate with Doctor Pence in executing a satisfactory contract with some land agent to sell at auction or…
