BOWMAN, Circuit Judge.

Frank J. Guinan appeals from the District Court’s 1 denial of his petition for Writ of Habeas Corpus pursuant to 28 U.S.C. § 2254 (1982). Guinan was convicted by a jury of capital murder in connection with the murder of a fellow inmate at the Missouri State Penitentiary. Guinan and another inmate entered the victim’s cell and repeatedly stabbed him with “knives” fashioned out of one half of a pair of scissors. The jury sentenced Guinan to death.
