HENLEY, Senior Circuit Judge.

Alan Bannister was convicted of capital murder and sentenced to death for the murder of Darrell Reustman. His conviction and sentence were affirmed on direct appeal. State v. Bannister, 680 S.W.2d 141, 147 (Mo. 1984), cert. denied, 471 U.S. 1009, 105 S.Ct. 1879, 85 L.Ed.2d 170 (1985). His motions for post-conviction relief were denied. Bannister v. State, No. 70715 (Mo.
