YETKA, Justice.

Appellant, Michael Alan Merrill, was convicted after a jury trial in St. Louis County District Court on one count of second-degree murder and two counts of first-degree murder. On appeal, he challenges the sufficiency of the evidence and the refusal of the trial court to instruct the jury on lesser included offenses and alleges prosecutorial misconduct in closing arguments. Appellant also appeals from an order of the district court denying his petition for post-conviction relief, which requested a new trial based on a claim of newly discovered evidence. We affirm the…
