Plaintiff commenced an action to recover against defendants upon a promissory note for $500, dated October 2, 1931, and due on or before May 12, 1932. The defendants answered admitting the execution of the note but denying that there was any sum due thereon. As a further and separate answer the defendants allege that the note in question was executed at the time they entered into a contract with plaintiff for the purchase of certain real property.
