The single question here presented is whether the action can be maintained against the defendant as a “voluntary association” under G. L. c. 182, § 6.
The facts respecting the First People’s Trust are agreed. It was formed by the execution of a declaration of trust dated October 28,1919. That declaration was signed by five individuals named therein as trustees and by no others. It is somewhat voluminous, but so far as material to the present litigation may be briefly summarized.
