For the purpose of disposing of the motion for a directed verdict we must deem that the following contentions, all being supported by substantial evidence, are the facts of this case. As the plaintiff approached the intersection of 39th and Knott streets from the south he brought his automobile almost to a stop a car’s length from the intersection and shifted into intermediate gear; at the same time he looked to his right along the course of Knott street and observed the lights of the defendant’s car approaching from the right.
