A. INTRODUCTION AND PROCEDURAL HISTORY
The instant adversarial proceeding is an action by the Trustee of a Debtor mortgage company to recover, originally, compensatory damages of over $14 million and punitive damages of $50 million against the underwriters and the sales agent on two fidelity bonds as the result of certain fraudulent conduct of the Debtor’s President and major shareholder, Richard Mi-cheel, and certain other high-level employees of the Debtor.
