At the regular session of the legislature of the State of Michigan in 1919, a resolution, *567ratifying a proposed amendment to the Constitution of the United States providing for national prohibition, was adopted. A petition in proper form, asking that such resolution be submitted to the electors for adoption or rejection under the referendum provision in our State Constitution, was presented to the defendant, who, on the advice of the attorney general, declined to act upon the same, and mandamus is-sought to compel him to do so.
