This matter is before the court upon the Magistrate Judge’s recommendation that (1) Defendant’s Motion for Summary Judgement be granted; (2) that Plaintiffs federal constitutional claim with respect to the debiting of his trust account be dismissed with prejudice; (3) that the remainder of Plaintiffs federal claims be dismissed, without prejudice, for failure to exhaust administrative remedies and/or pursuant to Heck v.
