This is an appeal by David P. Barnd, Jr. from a judgment of the Court of Common Pleas of Hancock County rendered upon a jury verdict finding him guilty of felonious assault in violation of R.C. 2903.11(A)(1).

This case arose out of a fight which occurred at a Findlay bar on September 1, 1991. The victim, Allen Grogg, claimed he was assaulted by David Barnd, appellant. At trial, the state claimed appellant approached the victim in the bar and pushed him several times for no apparent reason. The victim asked, “What’s your problem?” To which appellant responded, “Your face.”…
