The appellant, Clyde J. Cade, was convicted of murder, made capital because the victim was the Sheriff of Geneva County, who was performing a job-related act at the time of the murder. See § 13A-5-40(a)(5), Ala. Code 1975. The appellant was sentenced to death. The appellant's conviction was vacated by the United States Supreme Court, following the affirmance of his conviction and sentence by this court and the Alabama Supreme Court. Cade v.
