—Appeal from a decision of the Unemployment Insurance Appeal Board, filed May 24, 1995, which ruled *719that claimant was disqualified from receiving unemployment insurance benefits because his employment was terminated due to misconduct.

Claimant worked for the employer as a management information specialist for 61/2 years. Following his conviction of the crime of driving while intoxicated, claimant was unavailable to report to work for 58 days because he was incarcerated in the local jail, as a result of which he was terminated from his position.
