HARALSON, Supernumerary Circuit Judge.

The appellant was indicted and tried for murder in the second degree, convicted of manslaughter in the first degree, and sentenced to eight years imprisonment.

Briefly stated, the evidence for the State tends to show that on the evening of March 6, 1971, the wife of the decedent, •Clarence Malcolm Harvison, with her two small children, was visiting with the wife of the appellant in his home.
